INFORMATION ON POWER OF ATTORNEY

 

Brazilian nationals or foreigners bearing a valid “RNE” (“Registro Nacional de Estrangeiros”) card can request that the Brazilian Consulate draw a public power of attorney for them. See “Procurações” (page in Portuguese).

However, for foreigners who do not have a valid “RNE”, even if they have a “CPF (“Cadastro Nacional de Pessoa Física – CPF”) number, the Consulate cannot draw public powers of attorney. In order to be valid in Brazil, powers of attorney must follow the procedures below:

  • they must be drawn according to the law of the place where the instrument is prepared;

  • the grantor's signature on the instrument must be authenticated by a notary public;

  • the notary public's signature must then be authenticated by a County clerk; and

  • the County clerk's signature must then be legalized by the Consulate (See Legalization of Documents);

  • if they are not written in Portuguese, the power of attorney must be translated in Brazil by a sworn translator (“tradutor juramentado”) and registered with a “Cartório de Registro de Títulos e Documentos” (a public office that files private documents in order to grant them the publicity required by law).
